Terms and Conditions for Participation in Services Offered by Caitlin Erica
This Agreement (“Agreement”) is entered into by and between the participant (“Client”) and Caitlin Erica (ABN: 71650543490, “Facilitator”), governing participation in any and all services, programs, courses, mentorship containers, digital products, retreats, workshops, coaching, or live events (collectively, “Services”) offered by the Facilitator, whether online or in-person.
By enrolling in, purchasing, or attending any Service, Client affirms understanding and acceptance of the following terms:
1. SERVICE SCOPE AND NATURE
The Services are designed to support personal growth, embodiment, spiritual development, and empowerment. Offerings may include live or recorded sessions, group containers, written materials, digital products, private coaching, or in-person experiences.
The Client understands and agrees that the Services are educational and experiential in nature and are not a substitute for medical, psychological, financial, or legal advice. The Facilitator is not acting as a licensed therapist, physician, financial advisor, or lawyer.
1A. READINESS & MENTAL HEALTH STATEMENT
Services may involve deep emotional, energetic, spiritual, or somatic work. They are not casual self-help programs and may stir strong internal experiences.
The Services are not designed to treat mental illness, diagnose psychological conditions, or replace professional medical or therapeutic support.
If the Client is currently experiencing serious mental health challenges, including untreated PTSD, dissociation, suicidal ideation, or a history of psychiatric hospitalization, they are strongly advised to seek guidance from their therapist or mental health provider before enrolling.
By accepting this Agreement, the Client affirms that:
They have the inner resources and support systems necessary to participate in the Services.
They take full responsibility for their own mental, emotional, physical, and spiritual well-being.
They enter with clear consent, self-awareness, and personal accountability.
2. CONFIDENTIALITY AND CONDUCT
The Client agrees to maintain the confidentiality of all content shared by other participants in group settings, including personal stories, identities, processes, and any material marked or understood to be confidential. Breach of confidentiality may result in immediate removal from the Services without refund.
Clients agree to enter all spaces (digital or physical) with reverence, respect, and responsibility. Abuse, harassment, plagiarism, or disruption will not be tolerated and may result in termination from the Services.
Both parties agree not to make public statements, social media posts, or private communications that would defame, disparage, or otherwise harm the other’s business, Services, or reputation.
3. PAYMENT TERMS
By enrolling in any Service — whether paying in full or via a payment plan — the Client agrees to honour the full financial commitment, regardless of attendance, completion, or personal circumstances.
Withdrawal, missed sessions, or non-participation does not release the Client from this obligation. All payments are non-refundable and non-transferable, unless expressly stated otherwise in writing by the Facilitator.
Failure to meet payment terms may result in immediate removal from the Services and legal recovery of outstanding balances, including legal and collection fees.
4. INTELLECTUAL PROPERTY
All materials provided through the Services — including audio, video, written documents, session recordings, practices, frameworks, rituals, and course content — remain the intellectual property of Caitlin Erica.
The Client agrees not to copy, reproduce, modify, teach, distribute, publicly share, or commercially use any part of the content without express written permission. Unauthorised use may result in legal action, including injunctive relief and monetary damages.
5. PERSONAL RESPONSIBILITY, SOVEREIGNTY, AND LIMITATION OF LIABILITY
Clients enter the Services voluntarily and take full responsibility for their own boundaries, choices, and wellbeing.
Deep emotional, energetic, or spiritual transformation may occur; all experiences, interpretations, and decisions are the Client’s responsibility. The Facilitator does not guarantee specific results or outcomes.
To the fullest extent permitted by law, the Facilitator disclaims all implied warranties and limits liability to the amount paid by the Client for the Services. The Facilitator shall not be liable for indirect, consequential, or incidental damages, including emotional distress, income loss, missed opportunities, or perceived harm.
6. ACCESS, TERMINATION, AND LIVE EVENT POLICIES
If the Services include time-limited access (e.g., replay access, resource libraries, or digital products), the Client understands that access will expire after the stated period, regardless of completion or downloads.
The Facilitator reserves the right to remove the Client from any Service at her sole discretion if behaviour is harmful, disruptive, or misaligned with the energetic field of the container. No refund will be issued in such cases, and all remaining payment obligations remain due.
6A. Photography and Media
Not all Services or Events are photographed or recorded. On occasion, an Event may have media presence and/or a photographer. Such Events will be clearly indicated at the top of the corresponding purchase or registration page with a photography disclaimer.
By attending an Event that is indicated as having photography or media, the Client grants permission to Caitlin Erica to use any photographs, videos, or other media captured during the Event for promotional, educational, or archival purposes without compensation or further consent.
Special exception: For photoshoots that are part of specific programs (e.g., the Strip Her course), media captured for the Client’s benefit will not be used for promotional purposes by Caitlin Erica without the express written permission of the individuals depicted. Clients retain all rights to photos taken of themselves and may use these images as they wish.
6B. Personal Property Disclaimer
Clients are responsible for their own belongings during live events or in-person Services. The Facilitator and event venues are not responsible for lost, stolen, or damaged personal items.
7. ASSIGNMENT
Clients may not assign, sell, gift, or transfer their enrollment or access to any Service without the Facilitator’s prior written consent.
This Agreement is binding upon and benefits the respective heirs, successors, and assigns of both parties.
8. DISPUTE RESOLUTION
Any disputes, claims, or disagreements arising under or in connection with this Agreement shall first be resolved in good faith through informal dialogue. If no resolution is reached, the parties agree to submit to mediation or arbitration before seeking litigation.
This Agreement shall be governed by the laws of New South Wales, Australia, and any legal proceedings shall be conducted within that jurisdiction. The prevailing party in any dispute shall be entitled to recover reasonable legal fees and costs.
9. ENTIRE AGREEMENT
This Agreement constitutes the full understanding between the Client and Facilitator and supersedes any prior discussions or informal agreements.
Amendments must be in writing and signed by both parties. No waiver of any term shall be deemed a waiver of any other term. If any clause is unenforceable, the remaining provisions remain in full effect.
10. ACKNOWLEDGEMENT AND CONSENT
By purchasing, enrolling in, or attending any Services offered by Caitlin Erica, including online courses, digital products, live events, workshops, coaching, or retreats, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. Your participation or use of our Services constitutes your full acceptance of this Agreement.
